3.1. When You Visit our Websites
When you visit the Websites, voluntarily register for the Services, or send us or Users communications or information as part of your use of the Services, we collect Personal Information (as defined in Section 3.2 below) about you.
3.2. Personal Information
Personal Information refers to any information that identifies you personally, including, but not limited to, contact information, such as your name, e-mail address, company name, address, phone number, event creation or registration information, IP address and any other information about yourself or your business. Personal Information can also include information about any transactions, both free and paid, that you enter into on the Websites, and information about you that is available on the internet, such as from Facebook, LinkedIn, Twitter and Google, or publicly available information that we acquire from service providers.

Sensitive Information refers to credit or debit card numbers, personal financial account information, Social Security numbers, passport numbers, driver’s license numbers or similar personal identifiers, racial or ethnic origin, physical or mental health condition or information, or other employment, financial or health information.

We may collect from you certain personal information of third parties (e.g., information gathered as part of a Wellness Offering or posted to a User Site) (“Personal Information of Third Parties”). You represent and warrant to us that any personal information of third parties that you provide us was gathered with the knowledge and full consent of such third party and that they have not communicated to you that they wish to opt out of having us collect their personal information or receive communications from us.
3.5. Credit Card and Financial Information
If you choose to use payment processing services or any paid features from us, then we collect and process payment information and certain financial information (e.g., bank account information) via the third-party service provider Braintree, a division of PayPal, Inc. (“Braintree”). Braintree provides all payment processing services for OfferingTree. By using the Braintree payment processing services you agree to the Braintree Payment Services Agreement available at https://www.braintreepayments.com/legal/gateway-agreement, and the applicable bank agreement available at https://www.braintreepayments.com/legal/cea-wells. Except for the information requested by Braintree in order to preform the services you request or to a pay any fees or bill from us, we do not collect Sensitive Information from you.
3.6. Information About Children
The Websites are not intended for nor targeted at children under 13, and we do not knowingly or intentionally collect information about children under 13. If you believe that we have collected information about a child under 13, please contact us at email@example.com, so that we may delete the information.
3.7. Active Collection of Personally Non-Identifiable Information
Actively collected personally non-identifiable information refers to information you voluntarily provide, which by itself, is insufficient to identify you and includes, but is not limited to, demographic information (e.g., geographic location, literacy/education level, profession, age, income range, sex).
3.8. Passive Collection of Personally Non-Identifiable Information
Please be aware that when you visit our Websites or Services, we collect and store personally non-identifiable information via certain tracking and analytics technologies. This personally non-identifiable information includes, but is not limited to, ad delivery information from us or our business partners, date and time stamps for when Websites were viewed, type of browser, IP addresses, location data related to your IP address, and other anonymous usage or statistical information related to your use of the Services or the Websites.

4.6. User Testimonials and Comments
We may post User testimonials and comments on our Websites, which may contain Personal Information. We obtain each User’s consent via email prior to posting the User’s name and testimonial.
4.7. Sharing and Disclosing Information
- We may share your Personal Information with certain service providers who offer information, products or services to you on our behalf. Examples of these type of service providers include (but are not limited to): payment processors, customer support providers, compliance or fraud detection providers, business analysis providers, technical functionality or technical support providers, marketing assistance or client communication providers. In all cases where we share your Personal Information with such service providers, the service providers are authorized to access and use your Personal Information only to the extent necessary to perform the specific service on our behalf and they are forbidden from using your Personal Information for any other purpose.
- A business partner wishes to offer a service, product, contest, promotion, or sweepstakes and you voluntarily choose to participate in the offering by providing your Personal Information. You understand that if you participate in such offerings, then the Personal Information you provide will be used for the purposes of promotion, sweepstakes, contests, or product and/or service fulfillment.

We use a variety of procedures and precautions to help protect your Personal Information from unauthorized access, use or disclosure. Unfortunately, we cannot guarantee or warrant that your Personal Information is safe from unauthorized access (e.g., hackers or other unauthorized persons / entities) despite our reasonable efforts to ensure security of our systems. All information that you provide to us must travel via infrastructures (e.g., the Internet, mobile networks) that are not under our control and that you must use at your own risk. In addition, we cannot control or protect information that you voluntarily send to or share with others, so please use common sense and proceed with caution before sending or sharing information to/with others. If you have reason to suspect that any individual or entity is using the Website or Services for the purposes of gaining unauthorized access to information, phishing, spam, misleading others, or impersonation, then please immediately contact us at firstname.lastname@example.org.

We retain Personal Information that you provide us as long as your account is active (i.e., you have logged into your account at least once within the past 120 days) or as needed to provide the Services to you. In addition, we will retain your Personal Information as necessary to enforce any of our contractual agreements, resolve any disputes, or comply with any legal obligations.
5. Tracking of Use Information
We use “cookies” to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a Web server. Cookies are not used to run programs or deliver viruses to your computer.
You have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the OfferingTree Services or Websites you visit. OfferingTree keeps track of the Websites and pages you visit within OfferingTree, in order to improve the overall user experience and operation of the Services.
5.2. Log Files
We may collect demographic information, such as your ZIP code, age, gender, preferences, interests and favorites using log files that are not associated with your name or other personally identifying information. There is also information about your computer hardware and software that is automatically collected by us. This information can include: your IP address, browser type, domain names, access times and referring website addresses. This information is used by OfferingTree for the operation of the Services, to maintain quality of the Services, and to provide general statistics regarding use of the OfferingTree Website.
5.3. Clear Gifs (Web Beacons/Web Bugs)
We employ a software technology called clear gifs (a.k.a. Web Beacons/Web Bugs), that help us better manage the Services by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. In contrast to cookies, which are stored on a user’s computer hard drive, clear gifs are embedded invisibly on Web pages or in emails and are about the size of the period at the end of this sentence. We use clear gifs in our HTML-based emails to let us know which emails have been opened by recipients. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns. If you would like to opt-out of these emails, please see the section 6.3 below.

We utilize third party analytic services to help us continually improve our Services and the Websites. For Google Analytics, you may opt out by visiting the opt-out webpage for Google Analytics and installing the applicable add-on for your web browser.

“Do Not Track” refers to a preference you may set in your browser that sends a signal to websites indicating your desire not to be tracked. We do not currently support “Do Not Track” or other similar browser preferences. 6. Opting Out, California Privacy Rights and Unsubscribing
6.1. Changing, Correcting or Deleting Information
If you provide us with your Personal Information, you may contact us at anytime at email@example.com to change, correct or delete your information. We will respond to you as soon as possible, which means no more than 30 calendar days.
6.2 California Residents
If you are a resident of California and use our Services, then you have the right, without charge and once per calendar year, to request from us certain information (e.g., names, addresses, and a list of categories of information) about the Personal Information we shared (if any at all) to third parties for direct marketing purposes during the immediately preceding calendar year. To exercise your rights, you may make one request each year by emailing us at firstname.lastname@example.org.
6.3. To Unsubscribe From Our Communications
You may unsubscribe from our communications by clicking on the “unsubscribe” link located on the bottom of our emails, or by sending us an email at email@example.com. You cannot opt out of receiving transactional emails related to your account with us or the Services.
